General Terms and Conditions – Vivienda JACK

Welcome to Vivienda JACK.
These General Terms and Conditions apply to every reservation and every stay at Vivienda JACK, located at the Mar Menor Golf Resort in Torre-Pacheco (Murcia, Spain).
By making a reservation, the main booker declares that they have read and agreed to these terms and conditions. The main booker is responsible for ensuring that all fellow guests comply with these terms and conditions.
1. Definitions
In these terms and conditions, the following terms are understood to mean:
Landlord
The owner and/or manager of Vivienda JACK.
Accommodation
The apartment Vivienda JACK including the associated inventory, amenities and parking facilities.
Main booker
The person making the reservation and acting as the contracting party.
Guest(s)
Every person who uses the accommodation during the reservation.
Local management team
The persons responsible on behalf of the landlord for reception, inspection, maintenance and support during the stay.
2. Applicability
2.1 These General Terms and Conditions apply to all reservations, agreements, and stays at Vivienda JACK.
2.2 By making a reservation, the main booker agrees to these terms and conditions.
2.3 Deviations from these terms and conditions are only valid if they are confirmed in writing by the landlord in advance.
2.4 If one or more provisions prove to be fully or partially invalid, the remaining provisions shall remain in full force.
3. Reservation
3.1 A reservation is final once confirmed by the landlord.
3.2 The main booker must be at least 18 years old.
3.3 The main booker remains responsible for all fellow guests throughout the entire stay.
3.4 The landlord reserves the right to refuse a reservation if there are valid reasons for doing so.
4. Payment
4.1 Payments will be made in accordance with the payment terms as stated on the invoice or in the booking confirmation.
4.2 If a payment is not received on time, the landlord may cancel or suspend the reservation.
4.3 Any payment costs or bank costs shall be borne by the guest.
5. Share
5.1 A deposit of €300 applies for the stay, unless otherwise agreed in writing.
5.2 The deposit must be paid in accordance with the payment terms as stated on the invoice.
5.3 After departure, the local management team inspects the accommodation.
5.4 If no damage, loss, violation of the house rules or additional costs are identified, the deposit will be refunded as soon as possible.
5.5 If damage or additional costs are established, the landlord is entitled to charge these in full or in part against the deposit.
5.6 If the damage is higher than the deposit amount, the main booker remains liable for the full remaining amount.
6. Cancellation and changes
6.1 Cancellations must always be communicated in writing.
6.2 The date on which the landlord receives the cancellation is considered the cancellation date.
6.3 The cancellation terms applicable at the time of booking apply to each reservation.
6.4 If the guest terminates the stay prematurely, there is no right to a refund, unless otherwise agreed in writing.
6.5 Changes to a reservation are only possible if availability allows.
7. Arrival and departure
7.1 Check-in is possible from 3:00 PM, unless otherwise agreed in writing.
7.2 Check-out must take place no later than 10:00 a.m.
7.3 The local management team will handle the reception and provide the necessary information for access to the accommodation.
7.4 The guest must complete the legally required guest registration in full before arrival.
7.5 If guest registration is not completed on time or in full, the landlord may delay access to the accommodation until the legal obligations are met.
8. Use of the accommodation
8.1 The accommodation may only be used for recreational stays.
8.2 Subletting or assignment of the reservation is not permitted without prior written consent.
8.3 The maximum number of guests is four people.
8.4 Additional guests are only permitted with the prior written consent of the landlord.
8.5 Parties, events or other gatherings are not permitted.
8.6 Commercial activities or professional work from the accommodation are not permitted.
8.7 Illegal activities are prohibited.
9. Pets and smoking
9.1 Pets are not allowed in the accommodation.
9.2 In the common areas of the Mar Menor Golf Resort, the rules of the Owners' Association apply. Dogs and cats must be on a leash. If required by law, dangerous dogs must wear a muzzle.
9.3 The use of drugs, weapons, and similar products is not permitted within the accommodation.
10. House rules
10.1 The current house rules of Vivienda JACK are an integral part of this agreement.
10.2 Guests are also required to respect the rules of the Mar Menor Golf Resort and the Owners' Association.
10.3 Violation of the house rules may result in the withholding of the deposit, liability for any damage incurred, or termination of the stay without entitlement to a refund.
11. Common facilities
11.1 Swimming pools, gardens, parking lots, and other common facilities may only be used in accordance with the applicable resort rules.
11.2 The use of these facilities is entirely at your own risk.
11.3 The landlord is not liable for temporary closures or restrictions of common facilities.
12. Damage and liability
12.1 The main booker is liable for all damage caused during the stay by himself or his fellow guests.
12.2 Damage must be reported directly to the landlord or the local management team.
12.3 The guest is responsible for any loss or damage to inventory, keys, wristbands, and other property of the landlord.
12.4 The landlord is not liable for loss, theft or damage of guests' personal belongings.
13. Indicative recovery and additional costs
If damage, loss, violation of the house rules or extra cleaning work is discovered during or after the stay, the following costs may be charged in full or in part.
The mentioned amounts are indicative and based on the usual repair, replacement, or cleaning costs. If the actual costs are higher or lower, the actual costs incurred will be charged.

Loss or damage of wristband €50 per wristband
Unauthorized extra guests €50 – €100 per person per night
Unauthorized parties or events €200 – €500
14. Privacy and guest registration
14.1 The landlord processes personal data solely for the purpose of executing the reservation, the stay, and fulfilling legal obligations.
14.2 All guests are required to complete the legally required guest registration in full before arrival.
14.3 External service providers, including Check-in Scan, may be used to perform this statutory registration.
14.4 Personal data will be processed in accordance with applicable privacy legislation and the privacy statement of Vivienda JACK.
15. Force Majeure
15.1 The landlord is not liable for the inability to fulfill obligations due to force majeure.
15.2 Force majeure includes, among other things: natural disasters, government measures, war, pandemics, strikes, prolonged power or internet outages, fire, floods, and other circumstances beyond the control of the landlord.
16. Complaints
16.1 Complaints should be reported as soon as possible during your stay, so that the landlord has the opportunity to resolve them.
16.2 Complaints that are only reported after departure and which could reasonably have been reported during the stay may no longer be processed.
17. Governing Law
17.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Spain.
17.2 Any disputes shall be submitted to the competent court in the region of Murcia, unless mandatory legal provisions provide otherwise.
